| 摘 要： | 对原有作品的表演及在原有作品基础上形成的录音录像制品包含原作作者和表演者或录音录像制作者的双重创造性劳动.因此,对表演和录音录像制品也会存在类似于演绎作品的双重权利,本文力图分辨表演者或录音录像制作者和原作作者对表演和录音录像制品分别享有哪些权利及其权利性质.

| Abstract: | The performance in the original works and the products of audio and video recording based on the original works contain the double creative work of the orginal performers and the makers of the audio and video recording products.Therefore,the products of performance and audio and video recording have the same double rights as that in performing the works.This paper distinguishes the rights and the characteristics of the rights between the performers or the makers of the audio and viedo recording products and the original writers of the works. |
