| 摘 要： | 阐述了经济因素、政治因素和国际环境因素在中日两国法律近代化发展过程中各占主流的主要观点。通过将精神因素即国民性与前三种因素分别进行比较,揭示了精神因素在两国法律向近代转型的过程中所发挥的重大作用。它不仅是日本法律自近代以来获得长足发展的重要原因,也是可以为中国法制发展有所借鉴的重要因素。

| Abstract: | The main idea is analyzed in the paper that economy,politics and international environments have played the main role in the modernization of laws in China and Japan.Through comparison of the spiritual factor,that is,the national character,the great function of the spiritual factor in the modernization of laws in China and Japan is unveiled.The factor is not only the major reason Japanese laws have developed rapidly in the modern times,but it is also the reference for the development of China's legal system. |
