民间文学艺术及派生作品权利研究与传承保护

民间文学艺术随着时代的变迁、历史的沉淀,作为传统文化的精华呈现出巨大的文化价值及市场经济价值,所以对其进行研究也是知识产权领域的热点之一。因其自身特殊的群体性、民族性、延续性等法律特性以及蕴含的丰富的民族认同情感,使得其众多理论观点未达到统一。本文以传承保护民间文学艺术的原则作为支点,探讨其权利主体、权利内容、管理制度以及其派生作品的保护、整理者权利问题。

Research on the Rights and Protection of Folk Literature and Art and Its Derivative Works

Considering the change of times and historical precipitation, works of folklore as the essence of traditional culture are presenting tremendous cultural and economic values, so the study of folk literature and art is a hotspot in the field of intellectual property rights. Unlike copyright, the collector of folklore works does not have the rights of import, return and inheritance, but the right to obtain funding. In view of the specificity of folk literature and art works, their derivative works should get correspond- ing protection and the collector of folklore works should have certain rights. In this article, a dual management system is pro- posed to protect folklore and its derivative works.
