| 摘 要： | 从社会转型的视角去研究法院调解能更深刻地理解法院在纠纷解决上的功能变迁。从对浙江省A县人民法院1982—2008年司法统计数据的梳理和分析看,基层法院在传统结案方式以调解为主的背景下,判决正日益普遍,呈现"调解判决两条腿走路"的结案状况,而结案方式的改变也是法院自身对社会转型的一种调整和适应。

| Abstract: | To study court mediation in the view of social transformation is a way to know deeply the function changes of courts in dispute resolution.Based on the civil case data of a basic-level court in Zhejiang province between 1982 and 2008,this article finds the rate of mediation has declined obviously and the rate of adjudication has grown consistently in case disposition.These changes in case disposition mean it is a new adjustment to the social transformation for basic courts. |
