| 摘 要： | 国有股权的形成及其行使体现了国家所有权实现模式的变革,其中,对于国有股权行使主体的厘清与法律定位,有助于国有资产保值增值和经济布局宏观调控等目标的实现。遵循文献分析、比较分析等研究方法,基于国有股权的特殊性,国家不可能充当国有股权事实上的行使主体,而国有资产监督管理机构也只能作为名义上的国有股权行使主体,最终是要由国有资产运营机构作为事实上的国有股权行使主体。国有资产监督管理机构的"去行政化"与国有资产运营机构的"市场化"相辅相成,并行不悖。

| Abstract: | The formation and performance of the state-owned stock right reflects the transformation of the ownership exercise and the mode of the country,and helps to increase the value of state-owned assets. Because of the particularity of the state-owned equity,the country may not act as the performing subject of state-owned equity in fact,and the state-owned assets supervision and administration institution may be only as the performing subject in name.The state-owned assets operation institutions may act as the performing subject in fact ultimately. |
