| 摘 要： | 论文深入探讨了社会转型期司法所推出的调解优先理念的内涵,认为调解和判决何者优先我国经历过不同的认识发展阶段,而主张"调解优先"理念却和科学发展观"以人为本"思想具有契合性。论文以上海市浦东新区人民法院为例,具体分析了"调解优先"理念在司法实践中是如何和法院的制度设计合理地相结合并得以应用,针对学界、司法界对于调解优先所提出的质疑,作者就调解优先是否偏离了法治,调解优先是否意味着调解万能,调解优先与司法职业化是否相矛盾等问题做了深入分析。

| Abstract: | The article discusses the nature of the idea of mediation priority in the social transformation.It experiences different stages to think which is prior between mediation and judgment.It is coincident between the idea of mediation priority and the idea of people first in scientific outlook on development.Take Shanghai Pudong court for example.It analyzes how to apply the idea of mediation priority to court systems.The article analyzes whether mediation priority deviates from the rule of law;whether mediation priority means mediation all-powerful;whether it is conflict between mediation priority and judicial professional. |
