| 摘 要： | 《刑法》第20条对正当防卫作了明确规定,相对于1979年刑法对正当防卫的规定更为具体,对有效保护公民的合法权益起了积极作用。但对正当防卫的条件———不法侵害并没有作出明确的说明。因此有必要从不法侵害的含义及特征入手,对可以实施正当防卫的不法侵害行为作一个科学的界定。

| Abstract: | In the 20th article of Criminal Law,there is a definite stipulation towards justifiable defense.Compared with the stipulations in Criminal Law of 1997,it is more specific and plays a more positive role in protecting citizen's legal rights and benefits.However,there is no explicit explanation towards the condition of justifiable defense-unlawful infringement.Therefore,the author starts with the implication and characteristics of unlawful infringement to sketch a scientific dividing line about when to execute justifiable defense. |
