关于编纂民法典的若干思考

编纂我国民法典应坚持适当借鉴外国的经验,注重继承和创新,重视发挥学者作用的原则,编纂模式应采用汇编与制定相结合的方式;在民法典的体系结构上应坚持人格权独立成篇,合同与侵权行为从债法中分离出来分别立法的观点,同时,应将知识产权法作为民法的重要部分纳入民法典;民法典的具体内容应体现全面丰富,可操作性强兼具一定灵活性的特点,应特别注意为新科技引起的社会关系提供可适用的民法规则.

On Compiling Code of Civil Law

In compiling China's civil code, we should stick to the principles of using properly the laws of other countries for reference, and of attaching great importance to inheritance and innovation; and giving full play to scholars' roles, we should adopt the style of combining the collection with making as the compiling pattern. For the systematic structure of the civil code, we should insist that the Rights of personality will be the separate chapter; that the contract and Tort will be separated from the law of Debts and enacted respectively; and meanwhile, the law of intellectual property Rights will be brought into the civil code as a most important component as well. The specific contents of the civil code should embody the characteristics of being all-round and rich, of stronger operability and of certain flexibility. Special attention should be paid to offering the applicable principles of the civil laws to the social relations caused by modern science and technology.
