| 摘 要： | 论述了随着人身损害赔偿案件的增多,法律界对残疾赔偿金或者死亡赔偿金是否作为精神损害抚慰金出现了严重分歧,这些分歧影响了司法实践中关于精神损害抚慰金的正确适用。根据由案例引发的争议,通过法理对残疾、死亡赔偿金与精神损害抚慰金进行分析,指出残疾、死亡赔偿金不同于精神损害抚慰金。
