票据案件诉讼的若干法律问题

票据纠纷的性质应当是票据上固定权利纠纷以及票据法调整的非票据的权利义务关系所产生的纠纷．在范围上，票据纠纷包括了因票据关系所产生的纠纷和因受票据法调整的非票据关系所产生的纠纷．票据诉讼，应当适用一套特殊的规则，这些规则包括诉讼经济原则、限制反诉、限制证据使用等，并且其管辖也不因金额大小而确定级别管辖，而是统一由基层法院进行审理．公示催告不属于诉讼，在程序上应把握申请主体、客体的合格．
