论产权清晰相对性的人性根源

产权是否清晰,是市场经济资源配置效率高低的关键,然而,即使从法律上看产权是十分清晰的,在现实经济运行中仍然会存在产权纠纷及资源配置效率低的问题,这是因为产权清晰既有绝对性又有相对性.笔者仅从产权清晰绝对性与相对性的矛盾入手,分析产权清晰相对性的人性根据及其现实危害,并探寻走出产权清晰相对性的路径,从而拓宽产权理论研究的视域,为完善社会主义产权制度提供理论借鉴.

On the Humanity Origin of the Relativity of Clarifying Property Rights

Whether the property rights is clarified or not is pivotal to the efficiency of the allocation of resources in market economy,however,although from the aspect of law,property rights is extremely clarified,there still exists property rights dispute and low efficiency of the allocation of resources in practical operations of economy because clarifying property rights possesses not only absoluteness but also relativity.This thesis focuses on the disparity between absoluteness and relativity of clarifying property rights,analyzes the humanity origin of the absoluteness of clarifying property rights and its actual crises,and seeks a solution to get rid of the absoluteness of clarifying property rights,hence it extends the researching sphere of property rights as well as brings about some theory references which aim to improve the socialist property system.
