| 摘 要： | 现代产权是一个法律概念,必须以法律为依托才会有生命;现代产权又必须摆脱与公权力的交织,成长为纯民事化的权利;同时,人类进步发展方向,要求现代产权实现由身份到契约的转变。对于农村和农民来说,土地产权无疑是最重要的产权。根据现代产权的以上特点,我国现代化发展的过程,特别是改革转型的过程,是农民不断获得土地财产权的过程;农民土地产权的未来发展趋势应是:赋予农民完全民事化、法律化和契约化的土地财产权。

| Abstract: | Modern property right is a legal concept,whose survival depending on the support of law.Modern property right is a civil right,which must break away from the intertexture of the public power.And modern property right is a contractualization right,which must complete the transition from status to contract.As to rural areas and farmers,undoubtedly,land property rights are the most significant property rights.Taking the features of modern property rights as a clue,the process of our national modernization development and transformation can be viewed as the process of farmers' continuously obtaining land property rights,and modern China should endow farmers with the land property rights of complete civilization,legalization and contractualization. |
