行政契约化视野下行政执法监督的进路

公共服务市场化并不意味着行政权从这些领域退出,而是被分包给了经营者,并在服务契约中得以体现。因此,行政执法监督体系应当覆盖到这种被契约化行政权。鉴于目前的监督体制和机制难以适应公共服务市场化的要求,必须建构新的监督体制,实现对契约化的行政权力的监督,并对行政相对人提供及时的救济。

the marketization of public service doesn't mean that administrative power quit from these fields.In fact,it is given to the managers.So the administrative law enforcement supervision should cover these contractualized administrative powers.Since the contemporary supervision system can adapt to the need of the public service marketization.We should reconstruct a new supervision system.
