| 摘 要： | 随着大数据逐渐成为一项具有深远影响的技术变革,人类开始进入了大数据时代。在大数据交易背景下,数据是具有价值性?独立性?稀缺性与可支配性的资源,符合财产本质的核心构成要素,具有财产利益属性。作为新型的数据财产不能归入传统财产权的范畴,应当赋予数据财产独立的民事权利地位,以保持财产权体系随着时代发展而与时俱进。数据财产权是一项纯粹的财产性权利,权利主体能够依法对数据财产享有控制?使用和获益权能。

| Abstract: | As big data gradually becomes a technological change with far-reaching influence, humans have begun to enter the era of big data. Under the background of big data transaction, data is a valuable, independent, scarce and disposable resource with the core elements to become a property and has property interests. As a new type of property, data cannot be classified into traditional property rights but shall be treated as an independent civil right to develop property right system with the times. Data property right is a pure property right. And the subject of rights can control, use and benefit from the data property according to law. |
