网络环境下版权合理适用制度的危机与化解

合理使用制度本是版权法中利益平衡的主要制度安排，但随着数字网络技术的发展，版权法原有的平衡机制被打破，合理使用制度受到严峻挑战。为更好地平衡网络环境下版权人和公众的利益，在我国著作权法修改时，应将“合理使用”制度由现行的“规则主义”立法模式变为“混合主义”立法模式；同时根据我国国情适当扩大网络环境下合理使用的范围，并对版权人享有的“技术措施权”进行严格规制，以防止其滥用“技术措施”损害公共利益。

Rational utilization of copyright under the network environment:crisis and solution

Rational utilization system is the major institutional arrangements to balance interests in the copyright law, but along with the development of network technology, the original copyright mechanism lost balance and reasonable use system was broken by severe challenges. To better balance, under the network environment, the in- terests of copyright owners and the public, China＇s copyright law should revise ＂fair use＂ system from the current ＂rules＂ legislation mode to ＂mixed＂ legislation mode. Meanwhile, fair use scope under the network environment should be broadened according to the present situation of China, copyright owners＇ right of ＂technical measures＂ should be strictly defined to prevent its misuse to guarantee public interests.
