从《清实录》看乾隆朝对回民案件的处断

纵观乾隆一朝 ,法律之于回族颇严。虽有“因俗而治”的民族政策 ,但在执行上往往走样。仅从《清实录》涉及回民案件的处断看 ,其处罚不仅比《大清律》正文明显加重 ,而且与他族同类案件相比较 ,对回族尤为严苛。充分体现了乾隆君臣“重法治回”的思想 ,暴露了统治者民族歧视和民族压迫的反动本质

On the Treatment of in Factual Record of Qing Dynasty

Through out the whole Qing Dynasty, legal treatment of Hui nationality was quite severe. Though the ethnic policy promised: "to rule according to their custom" the practice of the law was far from it. Factual Record of Qing Dynasty shows that the treatment of Hui nationality was more severe than both the corresponding clauses in the statute of Qing Dynasty and that of other nationalities. It reflects the understanding of 'ruling Hui nationality through severe law' in Qianlong time, the reactionary instinct of ethnic prejudice and oppression
