| 摘 要： | 协议管辖制度目前已发展成为国际民事诉讼中一项基本管辖权制度,并在晚近呈现出以下新的发展趋势:管辖协议形式要件的放宽;协议管辖适用范围的拓展;协议法院与案件联系因素的淡化。为保证协议管辖制度的合理运用,各国均对该制度作出了必要的限制。为顺应国际潮流,我国相对落后的协议管辖制度亟待进一步充实和完善。

Agreed Jurisdiction in International Civil Litigation |

| Abstract: | The system of agreed jurisdiction has now become one of the basic jurisdiction system in international civil litigation, and obtains many new developments. The application of the system of agreed jurisdiction is necessarily limited in every country for the purpose of its reasonable application. To follow the international trend, the same system in our country should be bettered. |
