| 摘 要： | 我国著作权法对职务作品的规定,难以区分职务作品和法人作品,同时一般职务作品和特殊职务作品也较难区别。此外,单位和作者之间的利益平衡存在诸多问题,这些都给司法实务带来极大不便。本文通过职务作品制度的比较法研究,检讨我国职务作品制度的不足并提出完善意见。

| Abstract: | According to the regulations of the assignment works in Chinese Copyright Law,it is difficult to distinguish the assignment work from corporation work . At the same time general assignment work and peculiar assignment work are also difficult to differentiate. Through comparing the systems of assignment works in other countries, the thesis tries to analyze the deficiency of our system, and presents some improving suggestion. |
