| 摘 要： | 排除危害是环境侵权中一种积极预防性的救济措施.环境侵权本身具有特殊性,加上我国现实环境不乐观及法律规定欠完善,排除危害责任在实践中形同虚设.有鏊于此,应该引入利益衡量原则、环境公益诉讼制度,健全和完善我国环境侵权救济制度.
