论管制刑的废除

管制是对罪犯不予关押,但限制其一定人身自由,由公安机关执行和群众监督改造的一种刑罚方法.管制作为我国所独创的一种限制自由刑,其雏形出现于民主革命时期,并在解放区得到广泛使用,1997年修订后的刑法中对其仍予以保留.但经过几十年的刑法实践,管制刑赖以存在的历史条件和社会基础已消失,使得管制刑的适用率极低,近乎"名存实亡",加之管制刑的存在有损于刑法体系结构的科学性,因此,有必要将它从刑法中废除.

On the Abolishment of Punishment of Control

Punishment of control is the lightest of five kinds of principal criminal penalty in the PRC.When a criminal offender is sentenced the penalty of control,he(or she) is not put into prison,but only his(or her) freedom is restricted.This kind of punishment is executed by public security authority and put under surveillance of the masses.The punishment of control is originally created in the democratic revolution times.It has played an important role in the history.But by now this penalty has lost its historic condition and its social fundament.In the criminal judicial practice,the penalty of control is barely applied and has become an empty title.Furthermore,the punishment of control damage rational structure of the penalty.So it is necessary to abolish the punishment of control.
