农民的社会平等权研究

平等是人类文明的信条，现代平等权已经从形式性平等过渡到实质性平等，从要求适用法律平等到要求立法平等。作为新一代人权的社会权，苛以国家积极的作为义务，以保障公民实质性平等权利的实现。当前，这种平等的社会权利在中国广大农民身上仍极其欠缺，因而亟待法律对农民的社会平等权手以规范和完善。

Research on Peasants＇ Social rights of Equality

Equality is human being＇s article of creed. Right of equality in modern times has changed from formal equality to virtual equality. We claim that equality should not only apply to the application of law, but also restrain legislature. Deemed as the new-generational human rights, social rights burden nations the duty of positive conduction in order to guarantee the achievement of citizen＇s factual right of equality. At present, the equally protected social rights are badly needed by Chinese peasants. They＇re eagerly waiting that the law would provide more considerable, factual and straightforward protection for them.
