| 摘 要： | 对于法的渊源,学者们有着不同的解释。然而法的渊源具有两个基本特征:规范性与形式性。在理解了法的渊源的基础上,应当把法的渊源定位于法律适用过程中,结合我国现行法律制度,确立法的渊源的识别标准,从而识别我国法的渊源。法的渊源的识别是为了构建我国法的渊源位阶结构,旨在从我国司法实践的角度,探讨法的渊源的位阶结构的价值。

| Abstract: | There are various explanations on forms of law.There exists however two basic features in it,that is,rule and formation.Having analyzed the forms of law,put it into operating process of law,integrated with China's current system,this article establishes the recognizing standard of forms of law in China.It also constructs the rank structure of Chinese law so as to discuss the value of rank structure in respect of judicature. |
