| 摘 要： | 2007年全国人大常委会对《民事诉讼法》做出了修改，但仍然存在不足：民事诉讼法总则和分则部分关于民事检察监督的立法规定并不统一，民事诉讼法仍未明确检察机关在民事检察监督中的地位。完善民事诉讼立法，全面发挥检察机关的民事检察监督职能，明确检察机关具体职权，有效发挥民事检察监督职能，具有重要意义。

| Abstract: | The standing Committee of the National People＇s Confess amended the Law of Civil Procedure in 1997, but there are still some weakness. The legislative inconsistencies of civil inspection and supervision in the general and the sub-section staements of the Law of Civil Procedure; and the unclear role procuratorial organs play in civil inspection and supervision. It is therefore significant in consummating the legislation of the Law of Civil Procedure, giving full play to the function of procuratorial organs in civil inspection and supervision, and to the function of civil inspection and supervision. |
