公用企业反垄断规制的法律经济学分析

不论是在理论分析还是社会现实中,公用企业垄断都引起诸多弊端。因此,在公用事业中引入竞争机制,打破公用企业垄断成为众多国家改革的内容。在建设和完善社会主义市场经济过程中,我国立法和管理部门也不断采取措施规制公用企业的垄断行为。结合我国国情,此后一段时期内,国内公用企业反垄断规制应集中在以下几个方面:价格监督、保证互联互通、禁止交叉补贴等。

Analysis of the Formulation of Regulations against Monopoly of Public Enterprises from the Perspective of Law and Economics

Monopoly of public enterprises leads to drawbacks both in theory and in practice.(Therefore) it is one reform in quite a few countries to introduce the mechanism of competition into public enterprises so as to combat their monopoly.In the process of developing the socialist market economy,legislation departments and administrations have kept formulating regulations against monopoly of public enterprises in China.Based on the China's actual conditions,the formulation of regulations against(monopoly) should focus on supervising the price,ensuring the inter-communication and forbidding(overlapping) subsidies.
