| 摘 要： | 为了防止公诉权的滥用,必须建立公诉权的制约机制。这一制约机制包括对积极公诉权的制约和对消极公诉权的制约。我国有必要借鉴国外成功的立法经验,重构公诉权制约机制,同时扩大目前推行的人民监督员制度的监督范围,开辟一条制约公诉权的新机制。

| Abstract: | To prevent abusing the prosecution power,the restrictive mechanism of the prosecution power must be established.The restrictive mechanism includes the restriction of positive and negative prosecution power.The criminal procedural law didn't establish effective restrictive mechanism of the prosecution power in our country.So we should use the experience of other countries for reference and establish afresh the restriction of positive and negative prosecution power and enlarge supervisory scope of people's supervisor system,so a new restrictive mechanism of the prosecution power will be created. |
