民法典亲属法篇对婚内侵权的立法规制

夫妻双方独立的民事主体地位,是夫妻双方互相尊重,互相保证权利的行使、义务的履行的前提。一方不履行法定义务,侵害配偶一方的合法权益,必然造成对另一方的侵权。认为在民法典亲属法篇中,应明确规定配偶权益以及婚内侵权的行为方式,确定不同的侵权责任形式以及损害赔偿的救济方式,对婚内侵权行为的防治多管齐下,由此才可有效地解决婚内侵权的多发性、多变性,同时解决婚内侵权损害赔偿的执行问题,从而真正最大程度地消除婚内侵权行为,为建立文明、稳定、和睦的婚姻家庭关系服务。

Discussion on Ruling the Matrimonial Tort in Chinese Civil Law Code

The independent civil status of both sides of husbands and wives is the premise,with which husbands and wives mutually respect and guarantee the effectiveness of equal rights and mutual responsibility.If one side does not fulfill the legal duty and violates the legal rights and interests of the other side of the spouse,he or she will inevita- bly cause infringement upon the other's lawful rights.The author thinks we should explicitly stipulate in the rights and inteersts of spouse as well as the way of behavior of matrimonial tort,and define the different responsibility forms of infringement as the relief way of compensation for damage in the part of relative law in Chinese Civil Law Code.Only do we prevent and control the matrimonial tort with sorts of resolutions,then we may effectively solve the complexity of matrimonial tort,simulataneously solve the implementation of compensation for damage of matrimonial tort.Thus we can eliminate the matrimonial tort in the greatest degree in order to serve for establishing the civilized, stable and harmonious marital relationship.
