文化遗产的法律保护:国际经验与澳门实践

澳门回归及赌权开放以来,经济一直受到博彩业一枝独秀、经济结构单一化问题的困挠。2009 年1 月,国家发展和改革委员会对澳门做出了“世界旅游休闲中心”的定位。2005 年7 月,澳门历史城区被联合国教科文组织正式列入世界文化遗产名录。澳门申遗成功为可持续旅游业的发展,以及将文化遗产作为一项资源进行开发与保护赋予了新的意义。在对澳门文化保护立法进行历史梳理的基础上,对2009 年特区政府制定的《文化遗产保护法(草案)》进行了评价。

The Legal Protection of Cultural Heritage: International Experience and Practice of Macau

Since the return of Macao to the mainland and the opening-up of the right of gambling, it has been troubled by its dependence on an exclusive gaming industry and a single economic structure. In January 2009, the National Development and Reform Commission made Macao as a "World tourism and leisure center". In July 2005, Historic Centre of Macao was formally registered in the UNESCO World Heritage List, which has since then been giving a new significance for the sustainable development of tourism, as well as the development and protection of cultural heritage as resources. On the basis of surveying the history of cultural preservation legislation in Macao, the paper evaluates the 2009 "Cultural Heritage Protection Law (Draft)".
