| 摘 要： | 刑罚的威慑功能,经常被一国的立法者和司法者所津津乐道.威慑往往与儆戒同日而语,有着丰富的内涵.它一般包含对社会上一般人的威慑和对犯罪者本人的遏制."严打"作为我国的刑事政策凸显着其要着力发挥刑罚的威慑效应,以实现刑罚的一般预防功能.然而刑罚威慑效应的发挥不能孤立地依赖刑罚的投入量,应密切注意它与其它相关因素的联系.否则刑罚的威慑就是刑罚的"暴力".

| Abstract: | Legislators and administrators are often delight in talking about the deterrent effectiveness of penalty. The deterrence here means the warning against general persons and the restraining of criminals themselves. As one of criminal policies in our country, "cracking down on crime" features such deterrence of penalty. But, however, deterrence is different from "violence". We mustn't depend exclusively on penalty but think highly of something related about it. |
