| 摘 要： | 环境法作为一门新兴的学科,其立法体系不够完善、没有确立环境法的根本目的,以及科技含量最重和调整范围非常广泛的特征,决定了环境法法律方法具有解释对象的广泛性、方法运用的灵活性以及各方利益平衡的静态特征,而这又与法律发现方法运用的创造性、环境法解释方法运用的根本目的性和利益衡量方法的特殊地位的动态特征紧密相关。

| Abstract: | As an emerging discipline,the legal system of environmental law isn't perfect,and the fundamental purpose hasn't been established yet.In addition,the environmental law includes most technological content and a very wide range of adjustment.So the legal methods of environmental law contains static characteristics with universality of interpretative object,flexibility of application of methods,balance of the interests of all parties,and dynamic characteristics with the creativity of application of method of legal discovery,the aim of methods of legal interpretation,the special legal status method of balancing of the interests.There is a close relationship between the static characteristics and dynamic characteristics. |
