论对离婚案件的心理调解

婚姻纠纷的良性解决对于构建和谐社会具有重要意义。人民法院在调解离婚案件时,由于法官知识结构的局限,可能会更多地关注案件本身的法律问题,而常常忽视如何化解诉讼双方当事人之间伦理、情感等心理方面积累的矛盾。为了有助于彻底化解婚姻当事人之间的矛盾,提高离婚案件的调解质量,本文提出了运用心理学方法参与调解的构想,并就离婚案件心理调解的若干问题,即心理调解的目标、原则以及对心理调解人员的选拔等提出了个人见解。

On the Psychological Mediation in Divorce Cases

Benign solution of marital disputes is of great significance for the building of a harmonious society,but the people's courts,because of the judges' limited knowledge structure,may be more concerned about the resolve of legal issues and ignore or even fail to realize the accumulated contradictions resulting from ethical,emotional and other psychological aspects between the clients.To resolve the conflicts between clients fundamentally and improve the mediation quality of divorce cases,this article presents the concept of applying psychological method in mediation and the views on relevant issues,such as the objectives,principles and the selection of psychological mediators are put forward.
