"Non-litigation" and Its Influence on the Construction of Modern Rule of Law

Non-litigation,as a value disposition of the traditional chinese law culture,is a must due to the natural condition and social structure at that time.It has the same historical reasonableness as the modern spirit of rule of law,which reflects people's common pursuit of the social ideal of the order and harmony under different social conditions.Howerver,it deviates from the spirit of western rule of law in practice,and then deeply influences the construction of chinese modern rule of law.So,it is sensible to seek for the combination of them,to face up to the positive and negative influence of "Non-litigation",and to carry out the construction of modern rule of law rationally.
