| 摘 要： | 针对《中华人民共和国国家赔偿法》的实施现状,指出了国家赔偿法本身存在的确认程序多余、缺乏强制执行措施、国家赔偿的范围过窄等缺陷。重点就国家赔偿的赔偿范围,从国家承担赔偿责任的行为范围和国家承担赔偿责任的侵权损害的范围两个方面进行了初步的探讨。
