Challenge and Response for Exclusionary Rule: From the Perspective of Investigation Function

The exclusionary rule carries behavior guidance function,which would encourage investigatory officers to follow the procedures prescribed by law,and carry out the investigation in legal and effective manner.Along with the implementation of Regulations on Excluding Illegal Evidence in criminal cases,the current investigatory system will face severe challenges,such as significant increase of non-confession rate,retraction rate and requests for exclusion,as well as decline of non-arrest rate,non-prosecution rate,and conviction rate.As such,the investigatory agency shall aim at establishing a new model of criminal investigation and improving the current system.In particular,investigatory officers shall be enrolled in systematic trainings,and a prevention mechanism for illegal evidence shall be adapted to pursue a investigatory system that is more scientific and reasonable.
