| 摘 要： | 软法是硬法的对称,软法有助于绕过主权限制,消除主权国家的签约疑虑,开展更深层的国际合作,更能真实体现和反映各主权国家对全球环境治理制度的预期,且其宣示的理念与全球治理有着高度的一致性,在全球环境治理中日益发挥着重要作用,其正在成为《国际法院规约》没有预见的新的国际法渊源。
