| 摘 要： | 随着公民法律意识的增强,夫妻忠诚协议作为一种新事物,越来越多地被运用于解决夫妻双方权利义务纠纷的实践。然而,围绕着夫妻忠诚协议效力产生的各种争论也愈发激烈。通过对学术界和司法实践中夫妻忠诚协议效力的各种观点的分析得出,应当有条件承认夫妻忠诚协议效力的结论,并对判断夫妻忠诚协议是否生效的要件提出了建议。

| Abstract: | With the intensity of people's legal consciousness,marital loyalty agreement emerges to be used in solving the disputes between husband and wife on rights and obligations in practice,which,however,has led to hot disputes increasingly.Through analysis on different academic and judicial opinions,it concludes that the legal validity of marital loyalty agreement should be admitted conditionally and some suggestions on judging its validity are offered. |
