| 摘 要： | 构建我国环境公益诉讼的制度的切入点是确立原告类型和体系设计。在主体体系构建中确立国家机关履行职责并行使环境公益诉讼为主导,以社会团体和公民个体行使环境公益诉权为核心,强调环境公益诉讼这架机器之最终“启动权”应交给普通公民。

| Abstract: | The key to set up the environmental public interest litigation of our country is to establish the patterns of plaintiff and the system design and to strengthen the responsibility and duty of state organs, such as the government and the prosecutorial. The system of the lawsuit main body is to give emphasis on the right of starting up the mechanism of litigation, with the state organs fulfilling their obligations and social organizations and common citizens made the qualified plaintiff. |
