公正定罪实现论纲

公正定罪是刑事法律运行所追求的最终目标之一。要实现这一任务,需要靠形式的定罪知识即法律的规定、实质的定罪知识即自然法与法治的理念、程序法律设置即保障实体法运行的公正的程序、定罪思维方式即解释法律的犯罪论的理论体系等要素的多元支撑,单纯依靠哪一个都不能保证公正定罪的实现,而必须依靠多因素的有机结合。在此前提下,各因素之间的契合性研究也是本题应有之意。因此,如何实现定罪公正之和谐的多元支撑是必须给予关注的课题。

A General Outline on Realization of Impartial Conviction

Impartial conviction is one of the ultimate objectives of the criminal law.In order to realize the objective,we need multiple guarantees including latitudinarian knowledge for conviction,essential knowledge for conviction,legal procedure,thinking method for conviction, and so on.Constructing a rational thinking method for conviction is a key to the realization of impartially conviction.But being the carrier of thinking method for conviction,our conventional criminal constitute theory is incomplete,so it needs to be reformed.It must be emphasized that only rational thinking method for conviction cannot guarantee the realization of impartially conviction.
