| 摘 要： | 第三人精神损害赔偿是精神损害赔偿制度的重要组成部分,国外对此有一定的研究,我国对该方面的研究与立法都很不完善,在制定侵权行为法之际,对第三人精神损害赔偿的构成要件进行分析,对完善我国的侵权损害赔偿制度,无疑具有重要意义。

| Abstract: | The indirect mental distress makes an important part of the mental distress system.The study on it abroad has reached a certain degree,while both study and legislation on mental distress in China are not consum-mate at all.This paper aims to make a tentative study on the constitution of indirect mental distress on the basis of foreign legislations and judicialpractice.Undoubtedly,whenconstituting tortlaws,theanalysis of indirectmental distress will have a significant meaning in consummating the tort and damage compensation system. |
