我国登记离婚制度反思

2003年10月1日起施行的《婚姻登记条例》取消了办理登记离婚要求当事人提供单位、村委会、居委会介绍信的规定，当年采取登记离婚解除婚姻关系的当事人就激增，再创历史新高，且登记离婚后又生新问题。这促使作者对完善我国现行登记离婚制度进行思考，并且提出修正登记离婚制度的方案。其一为，将法院作为登记机关，由其承担审查当事人离婚协议的责任，确保当事人、子女的权益；其二为，不改变现状，但是增加当事人登记离婚的限制条件，同时明确法院亦受理登记离婚。

On the Divorce Registration System in China

Starting from October 1, 2003, The Divorce Registration Regulations took effect, making no demand for certificates from such units as village committee and community committee. In that very year the divorce rate soared in China. This situation calls for some improvement in the divorce registration system. The paper holds that two points must be born in mind. First, the rights and benefits of the clients must be guaranteed. Second, some limitations should be laid on divorce registration, and courts should be specified as the venues for divorce registration.
