婚姻家庭关系中若干事实与法律效果的推定

婚姻家庭关系是一种特殊的民事法律关系,由于婚姻家庭中涉及身份关系的诉讼大多具有一定的隐秘性,当事人很难像一般财产纠纷那样较容易地保留或获取与案件相关的证据,使得对婚姻家庭案件的某些事实和法律效界的认定显得比较复杂。借助诉讼法理论学科中推定的概念,并运用其原理,就婚姻家庭法律关系中的若干事实与法律问题的推定展开研究,其中既包括法律效界的推定,也包括事实与法律定性方法之推定。与普通民事诉讼相比,推定在婚姻家庭民事诉讼中对于查明案件事实具有特别重要的作用和意义。

Inference of Nature Determination of some Facts and Inference of Legal Effectiveness

Marriage is a special civil relationship, which includes marriage relationship and family relationship, personal relationship and property relationship. It has not only juristic attribute, but also ethical and moral attribute. Consequently, it is complicated to identify some of the facts and legal effectiveness. This paper analyzes the notion of inference in litigant law and its principle, and conducts research into the inference of some facts and legal issues in marriage and family relations, including the inference of legal effectiveness and the inference of the facts and legal nature determination methods.
