| 摘 要： | 善意取得制度为现代民法确定的一项财产所有权取得的制度 ,其目的是为了保护交易安全。本文重点论述了善意取得制度的构成要件及法律效果。关于法律效果 ,着重分析了物权变动和善意取得所涉及的债权关系。希望即将出台的物权法典能对善意取得制度作出明确具体的规定 ,使其真正发挥保护交易安全的作用。

| Abstract: | The bona fide possession system ,as a system of obtaining the property possession, is established in modern civil law. It plays a very important role in ensuring the safety of commodity exchange. The author tends to make a resesch on the basic theory of bona fide possession system,especially on the components and the legal effects of bona fide possession. We hope that both China civil code and real right law will be established as soon as possible in order to establish Chinese bona fide possession system. |
