| 摘 要： | 新修订的<水污染防治法>明确规定超标排污水污染物属违法行为,要承担法律责任.但是,由于该法第七十四条"应缴纳排污费"之规定不明确,造成了实践中法律适用的困境.文章从超标排污行为的持续时间、超标排放的污染因子与间接排放三个方面,对该条进行法律解释,阐明法条真意,以使法律得到正确适用.
