生态补偿的法律制度化设计

本文所称生态补偿是指利用经济手段刺激行为主体减少对生态环境的损害并对保护资源的行为予以鼓励,通过对建立生态补偿制度合理性与可行性的分析,提出应将生态补偿确立为一项环境法律制度。生态补偿应以公平合理为原则,补偿对象的范围相当广泛,补偿方式包括财政转移支付、征收生态补偿金、建立生态补偿基金、优惠、补贴等,针对不同的情况应设计不同的补偿制度。

Designing A Legal System for Ecological Compensation

In this paper, ecological compensation refers to making use of economic methods to compel the agents to reduce damages to the ecological environment and encourage the agents to protect the resources. Through the analysis of reasonableness and feasibility of establishing ecological compensation system, it pointss out that ecological compensation should be adopted as a kind of environmental legal system.
