| 摘 要： | 量刑情节竞合是指同一案件中存在多种量刑情节的情况 ,包括同向量刑情节竞合和逆向量刑情节竞合。对于同向量刑情节的竞合 ,应在区分多种从宽情节的竞合和多种从严情节的竞合的基础上予以不同处理 ;对于逆向情节的竞合 ,应主张抵消说 ,但抵消说必须在量刑情节对于刑罚量的影响指数和量刑裁量程序两方面进行完善。

| Abstract: | The concurrence of circumstances of crime is the fact that there are several circumstances of crime, and it is divided into diverse concurrence of circumstances of crime and uniform concurrence of circumstances of crime.The former should be treated differently on the basis of the circumstances;the latter should be solved on the basis of influence index and procedure,and offset. |
