论职务犯罪特殊侦查措施适用制度的构建

当前,在查办职务犯罪案件中,检察机关适用职务犯罪特殊侦查措施存在着法律依据缺乏、技术装备缺少和理论支撑缺失等一系列的问题。对此分析职务犯罪特殊侦查措施的表现形式、特点及当前我国相关的立法现状,阐述构建职务犯罪特殊侦查措施的必要性,研拟出职务犯罪特殊侦查措施适用的制度的构建,在立法上必须制定《反贪污贿赂法》。在原则上,必须坚持合法性、必要性、比例性、令状原则。在内容上,必须规定适用的主体和对象、启动办法、监督和救济令法。
