论东盟经济争端解决机制的建立

随着东盟的不断发展,1996年东盟十国签署了有关争端解决机制的文件,2010年又签署了关于这一文件的具体版本。但是至今这些文件都没有通过成员国国内法的确认,实际上尚未生效。东盟现阶段关于争端解决机制几乎是照搬WTO（全称世界贸易组织）的有关规定,但是这一机制没有考虑东盟独特的特征。毕竟东盟和WTO仍有很大的区别。所以在建立东盟经济争端解决机制的过程中,应该分析东盟的经济争端特征,并比较东盟和世界其他经济组织的区别,总结出一套适合东盟自身发展的争端解决机制。

An Analysis on Economic Dispute Settlement Mechanism Model in ASEAN
