| 摘 要： | 航海过失免责的沿革,集中反映了承运人对其所承运的货物应承担的责任的归责原则或者基础。在国际海事委员会制定运输法草案的过程中,各国代表团对是否应该取消航海过失免责的意见并不统一。针对是否应该取消航海过失免责的争论,论述了取消航海过失免责对承运人的责任和义务、保险制度、共同海损制度等海事法律制度的影响。

| Abstract: | The evolution of the nautical fault exemption reflected the rule principle or the basis of the responsibility of the carrier for the cargoes carried. The opinions on whether the nautical fault exemption should be eliminated from every delegation were disunion during drafting the Draft Instrument on Transport Law by CMI. With regard to the dispute on whether the nautical fault exemption should be eliminated, the impression on carrier's responsibility and obligation, insurance system, general average system and other maritime legal system with elimination of the nautical fault exemption was discussed and analyzed. |
