摘    要:中国的土地资产运营与管理体制改革 ,以及土地市场的发育程度 ,滞后于企业改制和市场经济体制发展的进程 ,存在以下问题 :一是土地产权界定模糊 ,导致土地资产运营效率低下 ;二是政府对经营性土地使用权的让渡实行土地行政划拨制和土地批租制并存 ,致使企业处于不公平竞争环境中 ;三是政府以行政手段介入国有土地资产运营 ,滋生了严重的土地寻租活动 ;四是土地管理体制不完善。因此 ,必须大力培育土地市场 ,促进土地批租、土地使用权作价入股、土地出租和土地使用权转让 ,进而优化土地资源配置 ,并为企业改制提供土地市场条件。与此同时 ,政府要从经济、行政、法制等方面加强土地调控和管理职能

Abstract:Reforms in the land property operation and management system in China, and the development of land market, fall behind corporate reforms and the development of market economy. The following problems exist. First, the boundary of land property rights is ill defined, resulting in low efficiency land property operation. Then, the co existence of administrative appropriation and land ratification and renting in the transference of managerial rights of land use, brings in unfair competition among enterprises. Third, government interference in state owned land property operation by administrative means leads to problematic land renting activities. Finally, the land management system leaves much to be desired. Consequently, the land market must be cultivated with great efforts, behavior such as land ratification and renting, use of land as shares, land renting and transference of rights of land use encouraged, allocation of land resources optimized, and land market conditions provided for corporate reforms. Meanwhile, the government should strengthen its land regulation and management, economically, administratively and legally.
