| 摘 要： | 民间文学艺术的法律保护是当前国际社会正在寻求解决方案的焦点和热点问题.民间文学艺术权是一种"特别权利",它类似于知识产权,具有非物质性,但又不同于知识产权,它在权利性质、创新标准、客体范围等方面与传统知识产权都存在较大差异.它表现为非个体专有的独占性、长期性、不可转让性等特征.

| Abstract: | Legal protection of the right of folk literature and art is the focus issue which international community is seeking to find a solution to it. The right of folk literature and art, is similar to intellectual property right in its being non-material and it is different from intellectual property right in the nature of property, the standard of innovation and object sphere. It is characterized by monopolization, being long-term and non-transferential. |
