| 摘 要： | 20世纪80年代末,黑社会性质组织犯罪在我国大陆开始出现。我国《刑法》294条及相关司法解释对黑社会性质组织犯罪作了规定。根据有组织犯罪的特点有针对性地制定完善的"反黑法",从立法上细化黑社会性质犯罪的特征、增加财产刑及对"保护伞"现象作了界定。

| Abstract: | In late 1980s,gangland crime began to appear in the Mainland China.The term is defined in Item 294,the Criminal Law of the People's Republic of China as well as the relative judicial interpretations.Besides,the Anti-Gangland Law,a well-established special law,details the features of gangland crime,includes the penalty for property-oriented penalty,and defines the phenomenon of "umbrella". |
